You Can Help Holly Curry Get Justice for Herself and Her Six Kids
Our efforts to vindicate Kentucky homeschool mom Holly Curry have kicked into high gear. The CPS investigator HSLDA sued on Holly's behalf has asked the federal court to say that strip-searching kids during a non-emergency investigation is not a violation of her constitutional rights.
The investigator's motion is a big hurdle in what could be a long march to the United States Supreme Court.
This is a critical moment.
Holly has a chance to secure an important victory, but she needs your prayers and generous support today.
HOLLY'S NIGHTMARE BEGAN DURING A ROUTINE BUSY-MOM OUTING . . .
On her way to karate practice on a cool Kentucky morning, Holly stopped at Cobbler's Café to buy muffins. All six of her kids were safely buckled into the car seats of her well-maintained 10-passenger van. Rather than drag all six kids into the café, Holly decided to leave them in the van in front of the café for no more than 10 minutes.
The car was locked, and the air was on. Holly felt especially safe in this part of town because of how close the café is to the courthouse complex. Police are always in the vicinity. And that morning, Holly believed that the police were her ally against anyone who would want to harm or threaten her children.

THAT'S WHEN HOLLY'S MORNING TURNED UPSIDE DOWN.
Upon leaving the café, Holly returned to her van where she was met by two uniformed law enforcement officers. They did not suggest that Holly had broken any laws and they knew that no harm had come to Holly's children.
But the officers asked Holly for the names and dates of birth of her children, informing her that she was not being arrested, but that they would be notifying the Kentucky Department for Community Based Services, Division of Protection and Permanency—employing the same type of form that is used for suspected child abuse and domestic abuse.
(Holly had done nothing wrong, and her children were never at risk. But in today's changing world, we don't advise leaving young kids in a car by themselves.)
BUT THIS WAS ONLY THE BEGINNING.
The next day, Holly was visited by an investigative social worker who demanded to enter her home (without identifying herself or providing credentials).
When she discovered that the social worker did not have a warrant, Holly invoked her constitutional rights and refused to let the social worker inside. A short while later, the social worker returned with a sheriff's deputy—but still no warrant.
Holly reiterated that she was not comfortable allowing them to enter the home without a warrant, especially while her husband was still out of town. The deputy and social worker demanded that she let them in, threatening to obtain an order to remove all six children from the home if she did not let them in without a warrant.
Only when the officials repeated their aggressive and intimidating threats did Holly acquiesce to letting them enter her home, fearful that they would otherwise take her kids—two of whom were infants—away from her.
Once inside, the investigator not only privately interviewed Holly's oldest daughter but then proceeded to strip-search all six children (including her daughters) in front of the male police officer.
Thankfully, after finding no signs of neglect, the investigation was closed. However, because of the injustice done to the Curry family, HSLDA has filed a federal civil rights lawsuit on behalf of Holly and her children.
Holly and her family have bravely decided to stand up to this government intimidation and abuse of power. But it hasn't been easy. HSLDA is proud to stand with this family, and we believe that you would want the opportunity to partner with them as well. WHY IS HOLLY'S STORY SO HEARTBREAKING?
It's because the government responded irrationally at every turn. The commonplace circumstances surrounding this investigation should have been met with a just and reasonable response.
If Kentucky officials are going to threaten to remove Holly's children for a snack break on the way to karate class, then any family going about their normal lives is at risk of being violated by the very people sworn to protect their rights and safety.
The particulars of Holly's case should secure her victory, yet this is not a foregone conclusion. The Division of Protection and Permanency has asked the judge to dismiss our lawsuit and legitimize the invasive actions of the investigator and deputy.
As a result, we intend to put every effort into getting justice for Holly and her family. This is not only an important fight for them—but for every loving family. There are real situations where government intervention is needed to protect children from harm.
Sadly, in the case of the Curry family, the government officials were the source of harm—not the solution.
